Privacy Policy
This Privacy Policy (“Policy”) explains how The Moto Academy (“TMA,” “we,” “our,” or “us”) collects, uses, shares, and protects your personal information when you visit www.themotoacademy.com, any sub-domains, or our pages on Facebook®, Instagram®, TikTok®, YouTube®, LinkedIn®, and Twitter® (“Sites”). By using the Sites you consent to this Policy and to our Terms & Conditions.
1. Information We Collect
Identifiers: name, email address, postal address, telephone number, and social-media handle (when voluntarily provided—e.g., checkout or opt-ins).
Payment & transaction data: class registrations, bundle purchases, last four digits of card (processed by Shopify Payments / Stripe).
Internet / device data: IP address, browser type, referring URLs, timestamps, cookie IDs (via Shopify, Google Analytics 4, Meta Pixel).
SMS data: mobile number, opt-in date/time, SMS interaction (STOP / HELP). See Section 11.
2. How We Use Your Information
Process purchases, class bookings, and bundle redemptions.
Send transactional email and non-marketing SMS alerts about class schedules or weather cancellations.
Respond to inquiries and provide customer support.
Improve our Sites, products, and services through analytics and A/B testing.
Prevent fraud, ensure security, and comply with legal obligations.
Send marketing emails (only if you opt in) about new classes, events, or promotions. You can unsubscribe anytime.
3. Legal Bases for Processing (GDPR / UK GDPR)
Contract – to fulfill class registrations and transactions you initiate.
Consent – for email / SMS opt-ins and non-essential cookies in the EU/UK.
Legitimate Interests – site performance, fraud prevention, service improvement (balanced against your rights).
Legal Obligation – tax, accounting, and regulatory requirements.
4. Cookies & Tracking Technologies
We and our service providers use cookies, pixels, and similar tech to:

Deliver/measure ads (Meta Pixel).

Do Not Track / Global Privacy Control: Our Sites do not currently respond to DNT signals, but we honor Global Privacy Control (GPC) as a request to opt out of cross-site advertising tracking.

These providers may process data outside your country; we rely on Standard Contractual Clauses or equivalent safeguards where required.
6. International Transfers
We are based in the United States. By using our Sites you understand your information may be transferred to and stored on servers in the U.S. and processed subject to U.S. law. Where required, we use Standard Contractual Clauses or similar safeguards for EU/UK transfers.
7. Data Retention
We retain personal data while we have an ongoing business need, including to comply with legal, tax, or accounting obligations:
Order & class records: stored indefinitely to provide historical receipts, honor future class redemptions, and satisfy audits.
SMS phone numbers: kept while you remain opted-in and may be used for future class updates. Opt-out any time by replying STOP.
Marketing email lists: retained until you unsubscribe or we close the list.
You may request deletion at any time; we will honor verified requests unless retention is required by law.
8. Security
We use industry-standard administrative, technical, and physical safeguards (SSL, access controls, routine backups). No method is 100% secure, but we strive to protect your data.
9. Your Rights
EU/UK GDPR: access, rectify, erase, restrict, object, data portability, withdraw consent.
California CCPA/CPRA: know, delete, correct, opt-out of sharing, limit sensitive PI (we do not collect sensitive PI), non-discrimination.
Colorado, Virginia, Connecticut, Utah: similar rights to access, delete, correct, opt-out of targeted advertising.
Email info@themotoacademy.com to exercise any right. We respond within 45 days and may verify your identity.
10. Minors
Our Sites are not directed to anyone under 18. We do not knowingly collect data from children under 13. If we learn we have, we will delete it. Parents may request deletion via info@themotoacademy.com.
11. SMS / Text Messaging Policy

11.1 Opt-In & Consent
Voluntary participation via checkout opt-in or written consent.
Messages delivered through ActiveCampaign using automated technology; consent is not a purchase condition.
You confirm you are the authorized user of the number and 18+ (or have guardian consent).
11.2 Message Content & Frequency
Transactional only (e.g., class cancellation due to weather).
0–5 messages per class date; timing varies with operational needs.
11.3 Charges, Opt-Out & Help
Msg & data rates may apply; carriers not liable for delays.
Reply STOP to cancel; HELP for assistance.
11.4 Privacy & Security
Numbers stored securely, used only for this Program, never sold.
11.5 Program Changes
We may amend or terminate the Program with reasonable notice (SMS or email). Continued participation means acceptance of changes.
12. Third-Party Links
Our Sites may link to external sites; we are not responsible for their privacy practices. Review their policies before providing data.
13. Policy Changes
We may update this Policy periodically. The “Last modified” date shows the current version. Material changes will be announced via email or site banner.
